FREQUENTLY ASKED QUESTIONS

What is meant by tax structuring?

Tax structuring refers to the legal planning and implementation of measures aimed at minimising the tax burden of a private individual. This is done by making optimal use of tax rules and structuring leeway.

How can you help me with tax structuring as a tax advisor?

As a tax advisor I review your income, asset structure and life situation and develop targeted concepts – for example to exhaust allowances, structure gifts or optimise your investments.

When is tax structuring especially important?

For significant asset decisions (e.g. property purchase, inheritances, business succession or investments), early tax structuring can make the difference between a high tax burden and an optimal solution.

Is tax structuring legal?

Yes, tax structuring operates within the legal framework and uses legal options for tax optimisation. It is clearly distinct from illegal tax evasion.

What risks are there in tax structuring?

Without expert advice, faulty structures can lead to tax disadvantages or legal consequences. Support from an experienced tax advisor is therefore essential.

When should tax structuring begin?

Early planning is crucial. Ideally, tax structuring should take place before important financial decisions or transactions.

Can tax structuring also make sense for private individuals?

Yes, especially with larger assets, property ownership or planned gifts and inheritances, individual tax structuring can bring considerable advantages.

How does the choice of legal form affect the tax burden?

The legal form has a decisive influence on taxation. As a tax advisor I can support you in choosing the optimal legal form for your financial goals.

What role does depreciation play in tax structuring?

Depreciation allows the acquisition or production costs of assets to be claimed for tax purposes over their useful life, which can reduce the annual tax burden.

How often should tax structuring be reviewed?

Regular reviews, at least once a year, are recommended in order to react to changes in legislation or in your personal situation.

What role do loss carry-forwards play in tax structuring?

Loss carry-forwards allow losses of one year to be offset against future profits. In addition, under certain conditions losses can be carried back one year (loss carry-back under § 10d EStG).

How does the choice of assessment type affect my tax burden?

The choice between individual and joint assessment for married couples can affect the tax burden. As a tax advisor I always determine the solution that is most favourable for you.

What tax benefits do donations offer?

Donations to charitable organisations can be deducted as special expenses up to certain maximum amounts and thereby reduce the tax burden.

How can I save tax by using allowances?

Exhausting allowances such as the savings allowance or the training allowance can reduce the tax burden.

How does tax progression affect my tax structuring?

Under progressive taxation the tax rate rises with higher income. An even distribution of income can help to soften tax progression.

Can I save tax by shifting income?

Yes, shifting income to family members with a lower tax rate, e.g. through gifts, can lower the family's total tax burden.

How do child allowances affect my tax burden?

Child allowances reduce taxable income and can thereby reduce the tax burden. Alternatively, child benefit can be claimed.

What tax benefits do retirement provision expenses offer?

Contributions to statutory pension insurance or Rürup pensions can be deducted as special expenses and thereby reduce the tax burden.

What advanced tax structuring models exist for wealthy individuals?

Advanced structures such as family pool companies, holding structures, tax-efficient business succession or the targeted use of loss carry-forwards and allowances can offer considerable tax advantages.
However, these models should always be reviewed individually and implemented in a legally clean way.

What tax benefits does the use of family companies offer?
  • Family companies – e.g. in the form of a GbR, GmbH or asset-managing GmbH & Co. KG – offer numerous tax structuring options within the family group:
  • Tax-optimised wealth succession: by transferring company shares step by step, personal gift tax allowances can be used optimally (e.g. €400,000 per child every 10 years).
  • Lower tax burden: income can be distributed within the family among several shareholders with a low tax rate (income splitting).
  • Securing family values: assets remain in family ownership, while provisions in the articles of association (e.g. consent requirements, transfer restrictions) prevent unwanted access by third parties.
  • Shielding private assets: in particular when using a GmbH structure, liability risks and the private tax burden can be clearly separated.
  • Retaining valuation privileges for inheritance tax: with co-entrepreneur structures, under certain conditions (e.g. for business assets) the inheritance tax relief under §§ 13a, 13b ErbStG may apply.
  • A family company is therefore an effective instrument for long-term asset protection and tax structuring, but should always be structured individually and legally secured.
